As a personal representative (an executor or administrator) you’re legally responsible for the money, property and possessions of the person who died (the ‘estate’s assets’).

You’re responsible for the assets from the date of death until the date everything has been passed on to the beneficiaries. This is known as the ‘administration period’.

You may have to apply for probate before you can deal with some assets.

During the administration period you may have to:

pay any debts left by the person who died
sell assets such as properties or shares
pay tax on any income the estate generates
report the estate value, income and tax liability to HM Revenue and Customs

You can get professional legal advice and help, such as from a solicitor, to deal with any estate. You should consider this if the estate has a lot of assets or includes things like trusts.

If you’re dealing with the estate with someone else

If you’re not the only personal representative you should agree with the others:

where to hold financial assets - you can set up a bank account known as an ‘executorship account’ if needed
rules on making withdrawals or payments from any accounts connected to the estate
what assets you need to sell and when

Settling debts and taxes

You must pay any debts and settle the taxes for the person who died. This includes:

paying any unpaid bills
paying any unpaid personal taxes
applying for tax refunds
filling in a Self Assessment Return if needed
repaying any Overpaid Benefits

HM Revenue and Customs (HMRC) will tell you what taxes are owed or if any tax refunds are due if you use the Tell Us Once Service

Place a Notice In the Gazette giving any creditors 2 months to claim anything they’re owed. Do not distribute the estate’s assets until the 2 months is up. If you do and the estate then cannot afford to pay a debt, you may have to pay it yourself.

You must also value the estate and pay any inheritance Tax due.

Managing and selling assets

You may have to pay taxes for the estate if there is any new income while you’re dealing with it, for example profits from selling things like shares or property, or dividends from investments.

Selling shares or property

If you sell shares, investments or property that belong to the estate you may have to pay Capital Gains Tax on them if either:

they’ve gone up in value since the person died
they’ve gone up in value since being valued for Inheritance Tax

You do not pay Capital Gains Tax from the estate if you transfer assets directly to a beneficiary, for example property.

Reporting an estate to HMRC

You may need to send information to HM Revenue and Customs (HMRC) about the estate’s income from the day after the death until the date everything has been passed on to beneficiaries (the ‘administration period’).

What you need to send depends on:

the value of the estate
how much income it generated during this time
if there was any tax to pay

When you do not need to report the estate

If the only income the estate received during the administration period was from bank account interest and that was less than £500, you do not need to report the estate to HMRC.

Reporting on ‘simple’ estates

Report tax owed in the administration period simply by writing to HMRC (known as ‘informal arrangements’) if all of the following apply:

the estate was valued at less than £2.5 million when the person died
the total Income Tax and Capital Gains Tax due is less than £10,000
you did not sell more than £500,000 worth of assets in any single tax year during the administration period

To report the estate send a letter to HMRC at the end of the administration period, including:

your name, address and phone number
the name, address, National Insurance number, and Unique Taxpayer Reference (UTR) of the person who died
any Income Tax and Capital Gains Tax still due for the whole administration period
any Income Tax and Capital Gains Tax you have reported and paid during the administration period, for example if you sold the property.

Distributing the estate

Once you have paid any debts and taxes, or you are sure the estate has enough money to do so, distribute the estate according to:

the will
the law if theres no will

You may have to pay any remaining debts and tax bills yourself if you distribute the estate and do not keep enough money or assets in the estate to pay them.

If you paid tax on any income during the administration period, give anyone receiving that income a completed statement of income from estates form.

There is guidance for beneficiaries about tax on property, money and shares they inherit.

If you distribute property

If you are passing on a property you must update the property register with HM Land Registry.

Prepare final accounts

Once all the estate is distributed you can prepare the final estate accounts. These should be approved and signed by you and the main beneficiaries.

Useful information

Valuations for probate are legally required by HM Revenue and Customs in order to establish the value of a property as part of a deceased person's estate. The valuation must reflect the current market value at the time of death.

Valuing the estate of someone who has died is one of the first things to do if you're acting as the executor or personal representative for that estate.

You need to know the estate's worth to fill in the probate application forms and show whether or not Inheritance Tax is due. You would normally require the services of a lawyer for this.

What is Inheritance Tax?

Inheritance Tax is usually paid on an estate when somebody dies. It's also sometimes payable on trusts or gifts made during someone's lifetime. The tax is payable at 40% on the amount over this threshold or 36% if the estate qualifies for a reduced rate as a result of a charitable donation.

Increased threshold for married couples and civil partners

From October 2007, married couples and registered civil partners can effectively increase the threshold on their estate when the second partner dies, to as much as £650,000 . Their executors or personal representatives must transfer the first spouse or civil partner's unused Inheritance Tax threshold or 'nil rate band' to the second spouse or civil partner when they die.

Inheritance Tax thresholds

The Inheritance Tax threshold is the amount up to which an estate will have no Inheritance Tax to pay.

If the estate - including any assets held in trust and gifts made within seven years of death - is more than the threshold, Inheritance Tax will be due at 40% on the amount over the nil rate band. From 6 April 2012 people who leave 10% or more of their net estate to charity can choose to pay a reduced rate of Inheritance Tax of 36%.

In July 2015 budget introduced an additional nil-rate band that will apply if your home is passed on to a child or grandchild upon your death. This band will be £100,000 in 2017-18, £125,000 in 2018-19, £150,000 in 2019-20 and £175,000 in 2020-21. The new nil-rate band will be gradually withdrawn for estates with a net value of more than £2 million, at a rate of £1 for every £2 over this threshold.

Inheritance Tax exemptions and reliefs

Sometimes, even if your estate is over the threshold, you can pass on assets without having to pay Inheritance Tax. Examples include:

Spouse or civil partner exemption. Your estate usually doesn't owe Inheritance Tax on anything you leave to a spouse or civil partner who has their permanent home in the UK - nor on gifts you make to them in your lifetime - even if the amount is over the threshold;

Charity exemption. Any gifts you make to a 'qualifying' charity - during your lifetime or in your will - will be exempt from Inheritance Tax. A donation to charity in your will may also reduce the rate that the tax is paid at;

Potentially exempt transfers. If you survive for seven years after making a gift to someone, the gift is generally exempt from Inheritance Tax, no matter what the value;

Annual exemption. You can give up to £3,000 away each year, either as a single gift or as several gifts adding up to that amount. You can also use your unused allowance from the previous year but you use the current year's allowance first;

Small gift exemption. You can make small gifts of up to £250 to as many individuals as you like tax-free;

Wedding and civil partnership gifts. Gifts to someone getting married or registering a civil partnership are exempt up to a certain amount;

Business, Woodland, Heritage and Farm Relief. If the deceased owned a business, farm, woodland or National Heritage property, some relief from Inheritance Tax may be available.
